Tecumseh is unincorporated. It was platted in 1854, won the vote to be Shawnee County's first county seat in 1855, and lost it to Topeka three years later, and it has never had a city government since. That means there is no municipal tree ordinance here, no clearance standard, no notice-and-abate process, and nobody who will tell you a tree has to come down.

What applies instead is Shawnee County, and the county's reach is narrower than people assume. Its nuisance authority in unincorporated areas covers lots in platted subdivisions and parcels of four acres or less adjacent to an occupied residence, and the published vegetation rules address rank grass and weeds rather than trees. So the practical situation for a Tecumseh property owner is that the decision about a leaning bur oak over a driveway is entirely yours, and so is the exposure if it comes down on something. That is an argument for a documented inspection, not against one.

Development east of Topeka left a lot of mature trees standing where they were and built around them. A bur oak that grew up in open ground has a completely different structure from one that grew in a woodlot: low, heavy scaffold limbs reaching far out horizontally, because nothing was competing for light. Those limbs were fine for eighty years over pasture. They are a different proposition over a roof and a driveway. The useful test is whether an attachment looks like it grew to carry the load it now holds, and on an open-grown oak the answer is frequently no.

Then the ground changed. Grading for a house pad, a driveway cut, and irrigated turf over what used to be prairie sod all alter the root environment the tree spent decades adapting to. The tree responds slowly, which is why the calls we get here are usually about a limb that dropped without warning on a calm day. End-weight reduction on the long laterals and removal of deadwood in the upper crown handles most of it. Removal is the answer less often than the homeowner expects.

Tecumseh sits on the Kansas River about two miles east of Topeka, with US-40 along the south edge and a BNSF line running between the community and the river. Those two corridors shape access more than the trees do. Anything on the river side of the track has a limited approach, and anything close to the highway means staging a truck and a chipper where traffic is moving at speed. The ground itself is Kaw valley bottom, and it floods. Tecumseh was inundated along with Rossville and Silver Lake in the 1951 Kansas River flood, and Shunganunga Creek runs east to the Kaw nearby. On this soil, saturation is what precedes most windthrow. A tree with a full crown standing in ground that has been soaked for a week is holding on with less than it looks like.
